What happened in the Plevin case?

In 2014, the case of Plevin v Paragon Personal Finance Limited was heard at the Supreme Court.

The Supreme Court decided that Paragon Finance, by recommending that Mrs Plevin take out Payment Protection Insurance had misled her.

By not revealing how much of the fee owed for PPI was commission, they did not allow her to make an informed choice or consider alternative policies. This meant that Paragon had benefitted financially from the sale of PPI to the detriment of Ms Plevin.

As such, the Court ruled the bank had acted unfairly!

Because she was charged an excessive undisclosed commission by the broker who sold her PPI, it was deemed to be an unfair relationship for the purposes of the Consumer Credit Act 1974.

The result was that the commission was refunded to Mrs Plevin and she received her money back, plus interest.

What is a Secret Commission?

A Secret Commission is a Commission which you were not told about at the beginning of the financial arrangement. If you were told about the Commission but NOT told the amount of commission at the time, this is called a “Half secret Commission”.

If either of the above apply, you may be able to claim.

If a commission of over 50% of the PPI sale was paid (known as the tipping point), and the commission was not disclosed when you purchased the Policy, you may be able to claim under the Plevin rule.
